They govern (a) our mobile messaging program (Part A), (b) your use of our website at www.candeelanddowney.com (also reachable at downey.candeeland.com) (the “Site”) and our online booking services (Part B), and (c) how disputes between you and us are resolved (Part C). Our Privacy Policy, available at downey.candeeland.com/privacy-policy, is incorporated into these Terms by reference. Our Do-Not-Call Policy is attached as Appendix A.
| PLEASE READ THESE TERMS CAREFULLY. PART C CONTAINS A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A COURT ACTION, TO A JURY TRIAL, AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. IN ARBITRATION THERE IS GENERALLY LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS AS DESCRIBED IN SECTION C6. |
Your visit to our indoor playground at the address above (the “Venue”) is additionally governed by the Participation Waiver and Release of Liability and the Venue rules, which each adult must accept before entry.
Part A — Mobile Messaging Program Terms & Conditions
Stormlight Kids LLC dba Candeeland Kids Downey operates the Candeeland Kids Downey Mobile Alerts mobile messaging program (the “Program”). By opting in to or participating in the Program you accept and agree to this Part A, Part C, and our Privacy Policy. Regardless of how you opted in, you agree that these Terms apply to your participation in the Program. This Part A applies only to the Program and does not modify the Participation Waiver or any other agreement governing your visits to the Venue.
By opting in to or participating in the Program, you represent and warrant that you are doing so because you genuinely wish to receive messages from us, and not for the purpose of, or with any present intent of, manufacturing, initiating, or asserting any claim or litigation against us or any party acting on our behalf. If you enrolled with a desire to bring legal claims against us or our vendors, you agree to unsubscribe immediately using the instructions in Section A4 and to indemnify us and those vendors for any expenses, including reasonable attorneys’ fees, associated with any such claim.
A1. Program Description
Participants can expect to receive recurring automated text messages (SMS, MMS, and, where supported, RCS) from Candeeland Kids Downey relating to:
- Transactional and service messages — booking and party reservation confirmations, session reminders, waiver links, check-in instructions, party guest-list and headcount updates, schedule changes, weather or emergency closures, and responses to your customer support inquiries.
- Promotional messages — special offers, discounts, events, new attractions, holiday hours, and news from Candeeland Kids Downey.
Message content and frequency will vary with your activity and the bookings you make. We reserve the right to change message frequency and to change the short code or phone number from which messages are sent.
A2. Your Opt-In and Consent
A2.1 Consent to receive recurring automated messages. You agree to receive recurring automated marketing, promotional, transactional, and event-related text messages from Candeeland Kids Downey at the mobile number you provided at sign-up or any other number you later designate. These messages may be sent using an automatic telephone dialing system or other automated technology, and may include messages containing an artificial or prerecorded voice. By providing your mobile number, you represent and warrant that you are the account holder for, or a customary user authorized to consent for, that number, and that the number is your own and not someone else’s. Consent to receive automated marketing messages is not a condition of any purchase or of visiting the Venue. Message and data rates may apply, and message frequency varies. Your consent to receive messages sent using an autodialer does not mean that any or all of our messages are in fact sent using an autodialer.
A2.2 How to opt in; verified opt-in. You can enroll by (a) texting the designated opt-in keyword to the telephone number or short code we publish for the Program; (b) checking the text messaging opt-in box on a booking, party inquiry, waiver, or sign-up form on the Site; or (c) providing your mobile number to our staff at the Venue and confirming your enrollment. You acknowledge that your enrollment is completed through a verified opt-in process and constitutes your prior express written consent to receive the messages described in Section A1. Depending on how you signed up, you may be asked to confirm your enrollment by replying to a one-time verification message or entering a one-time passcode; completing that confirmation verifies your possession of the device and your affirmative agreement to these Terms. After you opt in you will receive a confirmation message. Example: “Candeeland Kids Downey: You’re in! Msg & data rates may apply. Msg frequency varies. Reply HELP for help, STOP to cancel. Terms: downey.candeeland.com/terms”
A2.3 Age. You must be at least 18 years old to enroll in the Program. Candeeland Kids Downey is a family venue, and the Program is directed to parents, guardians, and other adults. By enrolling, you represent that you are 18 or older.
A2.4 Message delivery time. While we endeavor to send messages during hours that are reasonable for most consumers, you understand and agree that we generally cannot determine your real-time geographic location, because privacy rules and technical limitations prevent your wireless carrier from sharing that data with us or our vendors. Technical factors such as network congestion, delayed delivery, or your device being off or out of range may also cause messages to arrive at unexpected times. Accordingly, your consent to receive messages includes consent to delivery 24 hours per day, including outside of any otherwise-applicable calling-hour or “quiet hours” window, to the fullest extent permitted by law. To the maximum extent permitted by applicable law, your consent supersedes, and you waive any claim based on, any federal or state restriction on the time of day at which such messages may be delivered.
A2.5 Electronic records and E-SIGN consent. Applicable law may require us to give you certain information in writing in connection with your consent. By opting in, you authorize us to provide that information to you electronically rather than on paper. You may withdraw this consent, update your information, or request a free paper copy by emailing candeelanddowney@gmail.com. To access and retain electronic records, you will need a device with a web browser and internet access and sufficient storage or a connected printer.
A2.6 Device identification and fraud prevention. You authorize the use and disclosure of information about your account and wireless device, where available, by and to your wireless carrier, Candeeland Kids Downey, and our service providers, including Twilio Inc. and our booking and marketing platforms, to help identify you and your device when you opt in and to help detect and prevent fraud. You also consent to the transmission of one-time passcodes or similar messages to confirm your intent to subscribe. See our Privacy Policy for how we handle your data.
A3. Message Frequency, Cost, and Changes
Message and data rates may apply. Standard message and data rates from your wireless carrier apply to all messages sent and received under the Program; contact your carrier for details on your plan. Message frequency varies based on your bookings, preferences, and the offers we choose to send. Transactional messages are sent as needed to service your reservations. You agree to receive messages periodically at our discretion, and daily, weekly, and monthly frequency will vary. We reserve the right to change message frequency and to change the short code or phone number from which messages are sent.
A4. Opt-Out and Revocation of Consent (STOP) and Help (HELP)
| To stop receiving messages at any time, reply STOP to any message you receive from Candeeland Kids Downey. You may also reply END, CANCEL, REVOKE, OPT OUT, UNSUBSCRIBE, or QUIT. We will honor your request within the time required by applicable law. After you opt out, you will receive a single confirmation message acknowledging your request; that one-time message does not contain marketing content, and you will not receive further messages from the Program unless you re-enroll.For help at any time, reply HELP to any message you receive from Candeeland Kids Downey. You will receive a message with customer support contact information. You may also contact us at (562) 966-0700 or candeelanddowney@gmail.com. Emailing or calling us is not a valid method of opting out; opt-outs must be made by replying with one of the keywords above. If you are enrolled in both promotional and transactional messages, replying STOP will unsubscribe you from all text messages, including booking reminders. We will continue to send booking confirmations and other required communications by email. |
Our messaging platform may not recognize opt-out requests that materially alter the standard keywords (for example, by adding extra words or sending the keyword within a longer sentence). We and our service providers will not be liable for failing to honor requests designed to circumvent our automated opt-out process. Our Do-Not-Call Policy is attached as Appendix A. To re-enroll after opting out, text the published opt-in keyword to our Program number or opt in again through the Site.
A5. Customer Support
For support with the Program, reply HELP to any message, email candeelanddowney@gmail.com, call (562) 966-0700 during Venue hours, or write to Stormlight Kids LLC dba Candeeland Kids Downey, 462 Stonewood St, Unit G33A, Downey, CA 90241.
A6. Supported Carriers, Devices, and Delivery
The Program is available on most major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, U.S. Cellular, and their subsidiaries and affiliates. If your device does not support RCS, the Program may send SMS or MMS messages instead; if your device does not support MMS, the Program will send SMS messages. The Program is offered on an “as-is” basis and may not be available in all areas or on all devices or handsets at all times, and may not continue to function if your wireless carrier changes its services.
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and is outside our control. We are not liable for delayed or undelivered messages, and neither are your wireless carrier or our service providers.
A7. AI-Generated Content
From time to time we may use generative artificial intelligence services provided by third parties, including our automated booking assistant, to help develop, personalize, suggest, or respond with the content of messages we send you, which may include AI-generated content. By enrolling and remaining in the Program, you agree to our use of such services, and you agree that our use of these services does not make those third parties the sender or initiator of, or otherwise responsible for, the messages.
A8. Change of Number; Reassigned Numbers
You agree to notify us promptly if you relinquish or change the mobile number you enrolled, by replying STOP from the old number (if possible) and opting in again from the new number, or by contacting customer support. You agree that, until you opt out or notify us of a change, we may continue to send messages to the number on file, and you will not hold us liable for messages sent to a number you gave us but later relinquished without notifying us.
A9. Prohibited Use
You agree not to use the Program to send or solicit any unlawful, fraudulent, defamatory, harassing, obscene, or infringing content, any content that discriminates on a protected basis, any malicious code, any content protected by HIPAA or similar health-privacy laws, or any content otherwise prohibited by applicable law.
A10. State Telemarketing Laws and Residency
A10.1 Compliance with state laws. To the extent applicable to the Program, we endeavor to comply with applicable state telemarketing and consumer-protection laws, including the California Consumer Legal Remedies Act and California Business and Professions Code telemarketing provisions, the Florida Telephone Solicitation Act and Florida Do Not Call Act, the Oklahoma Telephone Solicitation Act, the Maryland Stop the Spam Calls Act, the Washington Commercial Electronic Mail Act and related telephone-solicitation statutes, New Jersey’s telemarketing law, and the Virginia Telephone Privacy Protection Act.
A10.2 Residency and area code. For purposes of compliance with federal and state law, you agree that we may treat you as a resident of the state associated with the area code of the mobile number you used to opt in, and that we may rely on that area code for time-zone and quiet-hours purposes. You agree not to assert that you are a resident of, or were physically located in, a different state unless you have affirmatively notified us in writing of your state of residence. You further agree that any message we send in direct response to your message or request (including responses to keywords, opt-in, HELP, or STOP requests, and confirmations) does not constitute a “telephone solicitation,” “telemarketing sales call,” or similar term under federal or state law, to the extent otherwise applicable.
A11. Privacy
Our Privacy Policy, available at downey.candeeland.com/privacy-policy, describes how we collect, use, and protect information in connection with the Program. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

B4. User Submissions
If you submit reviews, comments, photographs, videos, or other content to us or tag us in content on social media (collectively, “Submissions”), you grant Candeeland Kids Downey a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, display, and distribute the Submission in connection with the promotion of Candeeland Kids Downey, subject to our Privacy Policy. B6. Third-Party Services
The Site links to and integrates with third-party services, including our booking platform, payment processors, waiver platform, map services, advertising platforms, and social media platforms. These services are governed by their own terms and privacy policies. We are not responsible for the content, availability, or practices of any third-party service.
B7. Disclaimers
THE SITE, THE PROGRAM, AND THEIR CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE PROGRAM WILL DELIVER ANY MESSAGE AT A PARTICULAR TIME OR AT ALL. NOTHING IN THESE TERMS LIMITS ANY WARRANTY OR RIGHT THAT CANNOT BE DISCLAIMED UNDER CALIFORNIA LAW.
B8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STORMLIGHT KIDS LLC, ITS AFFILIATES, AND THEIR RESPECTIVE MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THE PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THE PROGRAM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US THROUGH THE SITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). THIS SECTION DOES NOT LIMIT LIABILITY FOR PERSONAL INJURY AT THE VENUE, WHICH IS GOVERNED BY THE PARTICIPATION WAIVER AND APPLICABLE LAW, AND DOES NOT LIMIT ANY LIABILITY THAT CANNOT BE LIMITED UNDER CALIFORNIA LAW.
B9. Indemnification
You agree to defend, indemnify, and hold harmless Stormlight Kids LLC, its affiliates, and their respective members, managers, officers, employees, agents, and service providers from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the Site or the Program, your Submissions, your violation of any law or third-party right, your provision of a telephone number you were not authorized to enroll, or any assertion by you that is contradicted by your documented opt-in records.
Part C — Dispute Resolution and General Terms
This Part C applies to any dispute arising out of or relating to Part A, Part B, the Site, the Program, or the messages you receive. It does not apply to claims for personal injury at the Venue, which are governed by the Participation Waiver and Release of Liability.
C1. Agreement to Arbitrate
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO BRING OR MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. RIGHTS SUCH AS APPELLATE REVIEW MAY NOT BE AVAILABLE IN ARBITRATION.
Any dispute, claim, or controversy between you and us — or between you and any third-party service provider acting on our behalf to transmit messages under the Program or to operate the Site — arising out of or relating to the Site, the Program, these Terms, or the messages you receive, including the validity, scope, or enforceability of this arbitration agreement (a “Dispute”), will be resolved by binding, individual arbitration before a single arbitrator, and not in court, except that either party may bring an individual claim in small claims court if it qualifies. These Terms evidence a transaction in interstate commerce, and the Federal Arbitration Act governs the interpretation and enforcement of this Part C.
C2. Mandatory Informal Resolution First
Before starting an arbitration, the initiating party must first send a written notice of Dispute to the other that describes the claim and the relief sought and includes enough information to identify the account and the phone number at issue. You must send your notice to candeelanddowney@gmail.com or by mail to Stormlight Kids LLC dba Candeeland Kids Downey, Attn: Legal Notices, 462 Stonewood St, Unit G33A, Downey, CA 90241. We will send notice to the email address or mobile number on file. For 60 days after a complete notice is received, the parties will negotiate in good faith to resolve the Dispute, and either party may request an individual settlement conference by telephone or video. Completing this informal process is a condition precedent to starting arbitration, and any applicable limitations period is tolled while the process is pending.
C3. Class-Action and Jury Waiver
YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS OR PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING. YOU AND WE ALSO WAIVE ANY RIGHT TO A TRIAL BY JURY.
C4. Arbitration Administration and Rules
The arbitration will be administered by the American Arbitration Association (“AAA”) under its then-current Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules, as modified by these Terms; the rules are available at www.adr.org. The arbitrator will apply the substantive law of the State of California and may award any individual relief a court could award, including statutory damages and, where authorized by law and warranted by the individual claim, public injunctive relief. The arbitrator will issue a reasoned written decision. Unless the parties agree otherwise, any in-person hearing will take place in Los Angeles County, California, and hearings may be conducted by telephone or video. Payment of filing, administration, and arbitrator fees will be governed by the AAA rules; where those rules require a consumer to pay a filing fee, we will reimburse it upon request for claims under $10,000 unless the arbitrator determines the claim is frivolous.
C5. Mass-Arbitration Procedures
If 25 or more similar demands are asserted by or with the coordination of the same or coordinated counsel, the parties agree that the demands will be administered under the AAA Mass Arbitration Supplementary Rules or the provider’s then-current equivalent procedures, including staged filing and fees, selection of bellwether cases to be decided first, and a good-faith mediation of the remaining cases following the bellwether decisions. The arbitrator must nonetheless decide each individual claim on its own merits. Any applicable limitations period is tolled for demands held in abeyance under these procedures.
C6. Opt-Out of Arbitration
You may opt out of this arbitration agreement by sending written notice, within 30 days after you first become bound by these Terms, to candeelanddowney@gmail.com with the subject line “Arbitration Opt-Out,” or by mail to Stormlight Kids LLC dba Candeeland Kids Downey, Attn: Arbitration Opt-Out, 462 Stonewood St, Unit G33A, Downey, CA 90241, stating your name, the mobile number or email address at issue, and your intent to opt out of arbitration. Opting out will not affect any other part of these Terms.
C7. Severability and Survival
If the class-action waiver is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and heard in court, while all other claims will proceed in arbitration. This Part C survives termination of your participation in the Program and any termination of these Terms.
C8. Contractual Limitations Period
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITE, THE PROGRAM, OR THESE TERMS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ACCRUES; OTHERWISE, IT IS PERMANENTLY BARRED.
C9. Governing Law and Venue
These Terms are governed by the laws of the State of California and, as to Part C, the Federal Arbitration Act, without regard to conflict-of-laws rules. For any Dispute not subject to arbitration (including if you validly opt out under Section C6), you and we agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
C10. Changes to These Terms
We may change these Terms from time to time. Changes to Part A or Part C will be communicated to you by text message, email, or a notice on the Site, and will not take effect earlier than seven (7) days after notice unless required by law; the version in effect when you received notice will govern until then. Other changes take effect when posted on the Site with an updated Effective Date. Your continued use of the Site or participation in the Program after the effective date of a change constitutes acceptance of the updated Terms. Changes to Part C will not apply to a Dispute for which a notice under Section C2 was received before the change took effect.
C11. Miscellaneous
You represent that you have the authority to agree to these Terms. These Terms, together with the Privacy Policy, the Participation Waiver, and any booking-specific terms presented at checkout, constitute the entire agreement between you and Candeeland Kids Downey regarding the Site and the Program. Our failure to enforce any right is not a waiver of that right. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. You may not assign these Terms; we may assign them to an affiliate or successor. Notices to you may be sent to the email address or mobile number you provided. Section headings are for convenience only.

It is our policy not to send telemarketing text messages to (a) any number, using an automatic telephone dialing system, for which we have not obtained prior express written consent as defined by FCC rules; or (b) any number on our internal Do-Not-Call list.
We maintain an internal Do-Not-Call list and will honor a request to be added to it within a reasonable time not to exceed the period required by applicable law. To be added to our internal Do-Not-Call list, you may:

We train personnel involved in the Program on this policy, retain opt-out records for at least five (5) years, and review this policy at least annually.
